1. Acceptance of Terms

By accessing or using FundFlow ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Service.

2. Eligibility

You must be at least 18 years old to use FundFlow. By using our Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will not use the Service for any illegal purpose
  • All information you provide is accurate and truthful

3. Fundraiser Requirements

Fundraisers who receive donations through FundFlow must:

  • Provide accurate identity verification information as required by federal law
  • Comply with all applicable federal, state, and local laws regarding fundraising
  • Accurately represent their fundraising purpose and use of funds
  • Report all income to the IRS as required by law
  • Maintain proper records of all donations received
  • Complete KYC (Know Your Customer) verification before receiving payments

4. Prohibited Activities

You may not use FundFlow to:

  • Engage in fraudulent, deceptive, or misleading activities
  • Raise funds for illegal activities or prohibited causes
  • Violate any applicable laws, regulations, or third-party rights
  • Harass, abuse, or harm other users
  • Transmit viruses, malware, or other harmful code
  • Attempt to circumvent security measures or access unauthorized areas
  • Use bots, scrapers, or automated tools without permission

5. Payment Processing

All payments are processed through Stripe, Inc. By using our payment features:

  • You agree to Stripe's Terms of Service and Privacy Policy
  • We charge a 2.9% + $0.30 platform fee per transaction
  • Donations are final and non-refundable unless required by law
  • We may hold funds for security or compliance reviews
  • Tax reporting (Form 1099-K) is required for fundraisers receiving $600+ annually

6. Tax Responsibilities

FundFlow is not a tax-exempt organization. Donations made through our platform may not be tax-deductible. Fundraisers are responsible for reporting all income to the IRS and paying applicable taxes. We will issue Form 1099-K to fundraisers who receive $600 or more in a calendar year as required by IRS regulations.

7. Anti-Money Laundering (AML) Compliance

FundFlow complies with the Bank Secrecy Act, USA PATRIOT Act, and FinCEN regulations. We implement Customer Identification Programs (CIP) and monitor transactions for suspicious activity. We reserve the right to report suspicious transactions to authorities and may freeze or terminate accounts involved in potential money laundering or fraud.

8. Intellectual Property

All content, trademarks, and intellectual property on FundFlow are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ACCURACY OF INFORMATION, OR FITNESS FOR A PARTICULAR PURPOSE. WE ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT OR THIRD-PARTY CONDUCT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold harmless FundFlow, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except you may bring claims in small claims court if eligible.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
